A High Court sitting in Lokoja has once again been asked to stop the Kogi State Independent Electoral Commission from conducting election into the chairmanship and councillorship positions of Omala local government area.
In a suit instituted by Akpa Salisu, Amodu Abdul Omada, Joseph Achimugu and three others who are councillorship aspirants for the May 4th,2013 council election in Omala, urged the court to determine whether KOSIEC can validly conduct Local Council Election in Omala as no primary election as well as that for selecting ad-hoc delegates where earlier conducted by the PDP.
The claimants also in a written address of their application of originating summons, urged the court to determine whether KOSIEC can validly conduct local Council Poll in Omala without review, update and integration of voters register.
The suit which was instituted in High Court II holden in Lokoja,and fixed for mention on monday 21st,2013 also asked the court to determine whether KOSIEC can validly conduct election in the state as it has refused to display and publish copies of voters lists for verification exercise.
The suit by the claimant also said KOSIEC was not properly constituted to conduct the May 4th election in the state as its tenure has since expired and was never renewed.
The claimant urged the court to also determine whether the state chairman of KOSIEC who is a card carrying member of the PDP, and contested the House of Assembly Primaries in Kabba/Bunu consttuency can validly conduct local Government Election in Omala and by extension the 21 Local Government Councils in the State.
The claimant who listed electoral laws 2004 and other authorities to back up their claim,swore to an affidavit,joined Labaran Yahaya Oyigebe and the State Attorney General of Kogi State as defendants, has J. U. Usman Esq as its counsel.
